At Rotherham on Monday, Jonathan Cooper (35), grocer, of 61, Knollbeck Lane, Brampton Bierlow, was summoned for having driven a motor car without due care and attention. A similar summons had been issued against William Lawson (64), engineer, of 45, Laithes Lane. Smithies. Barnsley, who was also accused of having driven a motor car with inefficient brakes.
Mr. A. S. Furness, solicitor (of Gichard and Co.), appeared for Mr. Cooper, and objected to his client being called to give evidence for the prosecution without subpoena. The objection was upheld.
The evidence showed that while the cars driven by the defendants were at the Brampton Bierlow cross roads, at 12.45 p.m. on March 9th, there was a slight collision in which some damage was done.
The defendant Lawson, in answer to the magistrates’ clerk, said he did not want to give evidence against Mr. Cooper.
In a statement on his own behalf he admitted that the brakes of his own car were defective, though he did not know it at the time.
Mr. Furniss submitted that there was no case at all against Mr. Cooper.
The summons against Mr. Cooper was dismissed. Mr. Lawson was fined 20s. for having driven without due care and attention, and a similar sum for having driven with defective brakes.
